Fastpost LLC – Terms and Conditions

Thank you for visiting Fastpost.com. Fastpost LLC will be referred further in this document as “we”, “us”, or “our”. Customers, Agents or any user of our services will be referred to as “customer” or “you”.  These Terms and Conditions are effective for all products and services that are offered by Fastpost LLC, including Fastpost.com.

This Terms and Conditions document is a general agreement between Fastpost LLC and users of our website, products, or services. By using our website, products, or services you are agreeing to the Terms and Conditions detailed here. Please review the Terms and Conditions specified here before you use our website, products or services. If you do not agree to or accept our Terms and Conditions, please do not use our website, products, or services. The Terms and Conditions explained here can be subject to change without prior notice and solely at our discretion based on emerging technologies, business practices, and customer needs.  Customers understand they have the responsibility to check for any changes in the Terms and Conditions periodically.

All content including but not limited to text, graphics, logos, icons, images, online tools and software in all websites, partner portals, products, and services that fall under Fastpost.com’s domain are the property of Fastpost LLC and are protected by the United States Copyright laws and other relevant Intellectual Property laws.

Our Services

Fastpost provides services including but not limited to Signpost Installation, removal and related services.  These services are available through our website and we authorize you to use all our services, provided you consent to our Terms and Conditions. Please note that we do not make any representation or guarantee as to the results you might obtain while using our services, including services offered by third parties.

Fastpost Equipment Used

Customer understands that the primary services provided by Fastpost are the installation and removal of customer provided signage at the requested location.  Customer understands that while there are no equipment rental fees associated with these services there are Fastpost materials (e.g. sign posts, stakes, brochure boxes, flyers, etc) that will be utilized and that customer assumes all responsibility for any lost, damaged or stolen Fastpost equipment.

User Agreement

Customer agrees to provide accurate information including time, place, address, cross street, map coordinates, and placement instructions for all orders.  Customer agrees to secure written permission from all HOA, Property Owners, and or City Officials for authorization to install any signage on requested property.   Customer/Homeowner is not allowed to remove or install Fastpost signposts and Customer agrees to notify homeowner of such restriction and accepts responsibility for homeowners action related to Fastpost equipment.

Inactive Listings

Customer agrees to promptly issue a “Removal Request” for any listing that is no longer active.  Customer agrees that Fastpost reserves the right to immediately remove any Fastpost equipment from an inactive listing or to charge customer’s credit card for any lost, damaged or stolen equipment.

Lost/Stolen or Damaged Equipment

Customer agrees to reimburse Fastpost for all lost, damaged or stolen materials utilized at the requested site.  These materials include sign posts, stakes, brochure boxes, riders, etc.  Customer authorizes Fastpost to charge any account or credit card on file for such charges.

Website Account

To place Orders and to use certain services, you are required to create an account at Fastpost.com and to provide various information including contact and billing information. We reserve the right not to complete your installation or offer our services if you provide invalid Information. You are entirely responsible for all activities that occur under your account and you must agree to notify us immediately of any unauthorized usage of your account or any other breach of security. We will not be held liable for any loss incurred as a result of someone else using your password or account, with or without your knowledge.  We make every effort to ensure accurate pricing, however due to unforeseen circumstances, pricing errors may occur. By submitting an Order or using our services, you are agreeing to pay the price relevant to the Order of the Service. Please review your Order carefully before you submit it and if you have any pricing questions, please contact us immediately.  Fastpost reserves the right to remove and Fastpost property (e.g. signposts, stakes, brochure boxes, etc) in situations where the customer has not paid for that installation.

Next Day Installation

Fastpost.com will generally install your sign the next business day after your order has been placed (Merced County is 48 hours). This service only pertains to standard residential orders placed on-line before 12 PM Monday through Friday excluding holidays. Next Day service does not apply to situations where road conditions, equipment failure, no Agent signs in stock or other situations that prevent installation.  Designated Fastpost holidays or closed days are excluded.

Order Cancellation

Orders can only be cancelled by contacting Fastpost during normal business hours (Tuesday – Saturday 08:00 – 17:00, excluding holidays).  Cancellation requests must be made directly with a Fastpost Representative.   Orders that have been scheduled or completed may be billed as completed. Fastpost reserves the right to charge for any services and/or materials utilized for a cancelled order.  Please allow 2-4 weeks for refunds to be processed and credited to your account.

Links to Other Sites

From time to time you may notice offers from other companies we are affiliated with, advertised on our website. We take precautions to select product or service providers who are responsible and able to provide privacy protection to you, incase you access their products or services. However, we cannot take any responsibility or make any representations about the practices and policies of the affiliate companies.

Modifications to the Website, Products, or Services

We reserve the sole right, for any reason, with or without notice to (i) terminate, change, suspend, or discontinue any aspect of our website, product, or service or in its entirety including features and hours of operation and availability, and (ii) impose limits on certain or all features of our website, products, and services, or restrict your access to a part or all of our website, products, and services. All or part of our website, products, or services can be subject to change with or without prior notice and solely at our discretion based on emerging technologies, business practices, and customer needs.

Refusal of Service

We hold the sole right to be the arbiter of what is and what is not a violation of our Terms and Conditions. We reserve the right to refuse service to, or terminate the Order of any user, for any reason, at our sole discretion. We also reserve the right at our sole discretion to require proof that you are authorized to distribute the content developed using our website, products, or services.

Indemnification

You shall indemnify, defend, and hold us, our officers, employees, and contractors harmless from and against any and all claims, losses, damages, liabilities, judgments, and fees and expenses related thereto (including attorneys’ fees), arising out of, based upon, or resulting from, any breach or violation by you of our Terms and Conditions or any use by you of our website, products, and services. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In no event, however, shall you settle or otherwise dispose of any such matter without our prior written consent.

Sprinkler Repair

Fastpost will not be responsible for any damage to sprinklers or underground utilities without an opportunity to first inspect any claimed damage and complete repairs.
